1. Definitions
1.1 Australian Standards All applicable Australian Standards and related documents, as amended from time to time.
1.2 Contract Any agreement, whether written, oral, or partly both, formed between the Client and Peel Test N Tag.
1.3 Client The individual, business, partnership, or company entering into the Contract with Peel Test N Tag, including any agent receiving the Goods and/or Services on behalf of another entity.
1.4 Peel Test N Tag Means Deanne Hosey trading as Peel Test N Tag.
1.5 Electrical Appliance Any single‑phase or three‑phase electrical equipment requiring or consuming electricity to operate, including kettles, televisions, fridges, power supplies, battery chargers, computers, microwaves and similar appliances.
1.6 Electrical Equipment Includes electrical appliances, leads, power boards and residual‑current devices.
1.7 Goods Any goods supplied by Peel Test N Tag under a Contract, including electrical equipment, signage, brackets and any other goods associated with the Services.
1.8 Goods and/or Services Any Goods and/or Services supplied by Peel Test N Tag under a Contract, including testing, tagging and minor repairs.
1.9 Guarantor Any guarantor specified in a Deed of Guarantee, if applicable.
1.10 Law All legislation, regulations, by‑laws, standards and orders issued by any authority with jurisdiction over the Goods and/or Services.
1.11 Minor Repairs Minor electrical repairs including plug top replacement, socket replacement and lead repairs.
1.12 Notice A notice issued in accordance with clause 19.
1.13 Party / Parties Peel Test N Tag or the Client.
1.14 Price Has the meaning set out in clause 6.1.
1.15 Price List The current pricing published on www.peeltestntag.com.au and updated from time to time.
1.16 Services Testing and tagging of electrical equipment, microwave leakage testing, three‑phase testing, RCD testing and minor repairs.
1.17 Terms and Conditions These Terms and Conditions, as amended under clause 20.1.
2. Operation of Terms and Conditions
2.1 All Contracts between Peel Test N Tag and the Client are governed exclusively by these Terms and Conditions. 2.2 These Terms override any contrary terms in Client documents. 2.3 These Terms continue to apply despite any repudiation or termination.
3. Supply of Goods and/or Services
3.1 Peel Test N Tag agrees to supply Goods and/or Services in accordance with these Terms. 3.2 Peel Test N Tag is not responsible for repairing, removing or replacing Electrical Equipment that fails to meet Australian Standards or any Law.
Disconnecting and Reconnecting Equipment
3.2A The Client is responsible for preventing loss of data or damage when equipment is disconnected for testing. 3.2B The Client indemnifies Peel Test N Tag for any loss arising from failure to comply.
Access Requirements
3.3 The Client must provide full, safe and unobstructed access to all items requiring testing. 3.3A If access is not provided, Peel Test N Tag may extend time or terminate the Contract.
Cancellation
3.4 The Client must provide at least 24 hours’ notice to cancel a booking.
Site Induction
3.5 Peel Test N Tag will participate in any required site induction.
4. Failed Items
4.1 Failed items will be tagged and must be removed from service immediately. 4.2 The Client must check test status and dates before using any Electrical Equipment.
5. Quotes and Tenders
5.1 Quotes are valid for 30 days. 5.2 Quotes do not create obligations until accepted. 5.3 All descriptions and specifications are approximate unless confirmed in writing.
6. Price and Payment
6.1 The Client must pay:
- the quoted Price or Price List rate
- parking costs
- call‑out fees outside the Peel Region
- induction fees
- all taxes and charges
6.2 Prices exclude Minor Repairs. 6.3 Failure to provide access or cancellation without notice may incur a fee up to $250. 6.4 Inductions exceeding 15 minutes may incur fees up to $85 per hour. 6.5 Invoices are issued upon completion. 6.6 Payment is due within 30 days. 6.7 Time for payment is essential. 6.8 Prices may change without notice. 6.9 Peel Test N Tag may vary payment terms or require upfront payment.
7. Costs Recoverable
7.1 All outstanding monies become immediately payable upon default. 7.2 Overdue accounts incur a weekly fee of $5.00. 7.3 The Client must pay all debt recovery costs.
8. Security
8.1 The Client charges all present and future property as security for payment.
9. Variations
9.1 Variations must be agreed in writing and may incur additional charges.
10. Representations
10.1 Peel Test N Tag is not liable for errors or misrepresentations not confirmed in writing. 10.2 Prior representations do not form part of the Contract unless expressly included.
11. Delay
11.1 Peel Test N Tag is entitled to reasonable extensions of time for delays beyond its control. 11.2 The Client must pay extra costs incurred due to delays.
12. Confidentiality and Intellectual Property
12.1 Confidential Information includes commercially sensitive information, client lists and internal documents. 12.2 The Client must keep Confidential Information secure. 12.3 Intellectual Property created under the Contract remains the property of Peel Test N Tag. 12.4 A limited licence is granted for use as required for the Contract. 12.5 Confidentiality obligations survive termination.
12A. Non‑Solicitation
The Client must not solicit Peel Test N Tag’s employees, subcontractors or agents without written consent.
13. Defects, Returns and Warranties
13.1 Defects must be reported within 7 days. 13.2 Peel Test N Tag is not liable for defects not reported within this period. 13.3 Peel Test N Tag may inspect alleged defects. 13.4 Inspection costs are payable if defects are not caused by Peel Test N Tag.
Risk and Ownership
13.5 Risk passes to the Client upon delivery. 13.6 Ownership does not pass until full payment is received. 13.7 Goods must not be sold or disposed of before payment. 13.8 Peel Test N Tag retains legal title until payment is complete.
14. Liability and Indemnity
14.1 Peel Test N Tag is not liable for indirect or consequential loss. 14.2 The Client indemnifies Peel Test N Tag for all costs and liabilities arising from the Client’s actions. 14.3 The Client is liable for enforcement and recovery costs. 14.4 No warranties are provided except those expressly stated.
15. Liability for Advice
15.1 Peel Test N Tag is only liable for written expert advice within the scope of the Contract. 15.2 No expert advice is provided outside the Contract. 15.3 Peel Test N Tag is not liable for informal technical advice.
16. Force Majeure
Peel Test N Tag is not liable for failure to perform due to circumstances beyond its control.
17. Termination
17.1 Peel Test N Tag may terminate the Contract if the Client breaches obligations or becomes insolvent. 17.2 Peel Test N Tag may terminate immediately for substantial interference or breach. 17.3 Upon termination, the Client must pay all outstanding amounts.
18. Assignment and Subcontracting
18.1 Peel Test N Tag may assign or subcontract any part of the Contract. 18.2 The Client may not assign the Contract without written consent.
19. Notices
19.1 Notices must be issued in accordance with this clause. 19.2 Notices may be delivered by hand, post or email. 19.3 Notices are deemed received as specified.
20. Miscellaneous
20.1 Peel Test N Tag may amend these Terms at any time. 20.2 Waivers must be in writing. 20.3 Invalid provisions do not affect the remainder. 20.4 Western Australian law applies. 20.5 Jurisdiction is the courts of Western Australia. 20.6 Interpretation rules apply as stated.
21. Receipt and Advice
The Client acknowledges receipt of these Terms and Conditions and accepts that they are legally binding.
